General Terms and Conditions (GTC)

1. Scope and Contracting Partner

For all orders placed through our online shop, the following General Terms and Conditions (GTC) apply. The contracting partner is:

2. Conclusion of Contract and Correction of Errors

The presentation of the products in the online shop does not constitute a legally binding offer, but a nonbinding online catalog. By clicking the order button, you place a binding order for the goods contained in the shopping cart. The purchase contract is only concluded when we accept your order by sending an order confirmation via email or by shipping the goods to you. Should products be marked with obviously incorrect prices (e.g., due to technical or typographical errors), we reserve the right to refuse acceptance of the contract or to challenge the contract due to error. Any payments already made will be refunded immediately in this case.

3. Prices, Shipping Costs, and Transfer of Risk

All prices stated on the website include the applicable statutory value-added tax plus any incurred shipping costs. The risk of accidental loss and accidental deterioration of the sold goods (transfer of risk) in consumer goods purchases only passes to the consumer or a recipient specified by them upon handover of the goods.

4. Warranty (Liability for Defects)

The statutory liability for defects applies. Insofar as we provide warranties, the details can be found in the warranty conditions attached to the respective delivered item.

5. Limitation of Liability

For claims based on damages caused by us, our legal representatives, or vicarious agents, we are always liable without limitation:

          in the event of injury to life, body, or health,

          in the event of intentional or grossly negligent breach of duty,

          in the case of warranty promises, insofar as agreed, or

          insofar as the scope of application of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the compliance with which the contracting partner may regularly rely (cardinal obligations), due to slight negligence by us, our legal representatives, or vicarious agents, liability shall be limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.

6. Copyright and Trademark Protection (Copyright & Trademarks)

All contents of our website, including texts, graphics, logos, images, and software, are the property of Barbarossa Moratti GmbH or its suppliers and are protected by international copyright laws. All brand, service, and trade names – in particular the name and the logo of "Barbarossa Moratti" – are protected trademarks. Any reproduction, editing, distribution, or any kind of exploitation outside the limits of copyright law requires our prior written consent.

7. Links to Third-Party Providers

Our website may contain links to external third-party websites over whose contents we have no influence. The respective provider or operator of the pages is always responsible for the content of the linked pages. A permanent control of the contents of the linked pages is not reasonable without concrete evidence of a legal violation. Upon becoming aware of legal violations, we will remove such links immediately.

8. Final Provisions, Amendments, and Severability Clause

We reserve the right to change our website, policies, and these GTC at any time. Your order is subject to the GTC that were available at the time of the order. Should a provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The relevant statutory provisions shall apply in place of the invalid provision. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
